minimum chain work is fine as long as it's not configured by developers, but versions of bitcoind ship with preconfigured values. This could allow that configuration to reject the valid chain, resulting in a stall - a soft fork. The code doesn't determine these, it's done by developers. So this will remain configurable and should really default to top checkpoint work. In any case it's done.
