up and running, might need to do some param tuning but so far seems to be chugging through. this is 1gbps , but im requesting a 10 gbps link for this box

The behavior associated with the valid-after-invalid issue would not cause a delay, it's no different than if that one block had been validated in the next batch. Since the batches aren't ordered, it's not consequential.
